These Terms and Conditions ("Terms") govern your use of the XpertAR platform ("Service"), operated by XpertXYZ ("Company", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

XpertAR is an augmented reality (AR) platform that enables photographers, album designers, frame makers, and creative agencies ("Users", "Editors") to create AR-enhanced photo albums, frames, and prints for their customers. The Service allows uploading target images and videos, generating AR experiences accessible via unique links and QR codes.

1A. XpertAR Mobile Application

XpertAR is the companion Android application ("App") that allows end users to experience AR content created on the XpertAR platform. The App is used to scan QR codes or open AR content links shared by Editors. By using the XpertAR App, you agree to the following additional terms:

• The App requires camera access to detect target images and display AR overlays (videos) in real-time.
• The App does not collect, store, or transmit any personal data, photos, or camera footage. Camera access is used solely for real-time AR image detection.
• AR content displayed through the App is created and managed by Editors on the XpertAR platform. We are not responsible for the nature or accuracy of the content.
• The App requires an active internet connection to load AR target files and video content.
• The App is provided "as is" without warranties. We do not guarantee compatibility with all Android devices.
• We may update or discontinue the App at any time without prior notice.

2. Account & Access

• Accounts are created by the platform administrator. You are responsible for maintaining the confidentiality of your login credentials.
• You must not share your account with others or allow unauthorized access.
• We reserve the right to suspend or terminate accounts at our sole discretion, with or without notice.

3. Credits & Payments

• AR content creation requires credits, which are purchased from the administrator.
• Credit pricing, offers, and rates are set at the sole discretion of the administrator and may change at any time.
• All credit purchases are final. No refunds will be issued under any circumstances.
• Credits are non-transferable between accounts.
• Unused credits do not expire unless the account is terminated.

4. Content & Intellectual Property

• You retain ownership of the images and videos you upload ("Your Content").
• By uploading content, you grant XpertAR a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute Your Content solely for the purpose of providing the Service.
• Your Content is made accessible to the public via unique shareable links and QR codes. You are responsible for controlling who receives these links.
• You represent and warrant that you have the right to upload and share all content, and that it does not infringe any third-party rights.
• We are not responsible for unauthorized distribution of your links or QR codes by third parties.

5. Acceptable Use

You agree not to upload, generate, or share content that:

• Depicts child sexual abuse material (CSAM) or endangers minors in any way.
• Is non-consensual intimate imagery, sexually explicit, or pornographic.
• Is hateful, harassing, threatening, defamatory, or promotes violence against individuals or groups.
• Impersonates any person or organization, or is otherwise deceptive or fraudulent.
• Infringes any third party's intellectual property, privacy, or other legal rights.
• Is illegal, harmful, or otherwise violates applicable law.

You also agree not to:

• Use the Service to distribute malware, spam, or engage in any fraudulent activity.
• Attempt to reverse engineer, tamper with, or exploit the platform's security or credit system.
• Exceed reasonable usage limits or abuse the platform's storage and bandwidth resources.
• Resell or sublicense access to the Service without written authorization.

5A. Content Moderation & Reporting

• Anyone who encounters content shared via an XpertAR link, QR code, or the XpertAR App that violates Section 5 can report it to admin@xpertxyz.in, including the content link and a description of the issue.
• We review reports and remove violating content within a reasonable timeframe.
• We may suspend or terminate the account of any Editor found to have uploaded content that violates Section 5, and may report unlawful content (including CSAM) to the relevant authorities as required by law.

5B. Age Requirement

The Service is intended for use by individuals aged 18 and over. Editor accounts must not be created or operated by minors. The Service is not directed at children under 13, and content uploaded must not depict minors without appropriate parental/guardian consent.

6. Data & Privacy

• We collect and store your account information (name, email, phone, address) and uploaded content.
• We track analytics data (views, visitor IPs, user agents) for content opened through AR links.
• We do not sell your personal data to third parties.
• You are responsible for obtaining consent from your customers whose photos/videos you upload to the platform.

7. Storage & Content Limits

• Images and videos are automatically compressed to optimize storage. Each video's length is limited to the duration of the plan selected for that AR item.
• We reserve the right to impose storage limits per account.
• We may remove content that violates these Terms or remains inactive for an extended period, with or without notice.
• Each AR item is purchased with an active period after which it stops functioning. The active period is shown at the time of purchase.
• "Lifetime" active period: where an item is purchased as "Lifetime", it remains active for an extended fixed term (currently up to 25 years from purchase), and in all cases only for as long as XpertAR continues to operate the Service. It is not a perpetual guarantee. If XpertAR ceases operations, is sold, or permanently shuts down the platform, Lifetime items stop functioning along with all other content. Lifetime applies only to the specific item purchased, is non-transferable, and does not entitle you to a refund if the Service is later discontinued.

8. Availability & Warranties

• The Service is provided "as is" and "as available" without warranties of any kind.
• We do not guarantee uninterrupted service, and may perform maintenance or updates at any time.
• We are not liable for any loss of data, revenue, or business arising from the use of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, XpertXYZ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

10. Changes to Terms

We reserve the right to modify these Terms at any time without prior notice. Continued use of the Service after changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

11. Termination

• We may terminate or suspend your account at any time, for any reason, without prior notice.
• Upon termination, your credits are forfeited and your content may be deleted.
• Sections regarding intellectual property, limitation of liability, and no refunds survive termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
